  • Buying and Selling Houses

It is usual for a Lawyer to handle the documentation involved in buying and selling houses.  Once you sign an Agreement for Sale and Purchase you are obliged to act in good faith.  It is prudent to talk to a Lawyer before signing any Agreement to ensure there are no pitfalls.

 

Purchasing involves documents such as the Client Authority & Instruction Form, loan papers, land tax statements and preparation of notices of change of ownership.  Selling involves documents such as Client Authority & Instruction Form, release of any mortgage, land tax statements and preparation of a settlement statement incorporating an apportionment of rates.

 

  • Buying and Selling Businesses

 

Again it is prudent to talk to your Lawyer before signing any Agreement for Sale and Purchase.  Most problems arise from a lack of communication between the buyer and the seller.  It is helpful to have most issues resolved prior to signing the agreement. If it is not possible for them to be resolved before signing the agreement then those issues should be set out in writing with an agreed formula as to how they should be worked through.

  • Wills

 

A Will is usually a written statement signed and witnessed in a formal way.  It sets out the names of your Executor or Executors and what you want done with your assets after payment of your debts.  It is prudent to have your wishes drawn up by a professional.  A Lawyer can ensure the formalities are done in a manner that complies with the requirements of the Wills Act.

  • Enduring Powers of Attorney

 

Powers of Attorney give someone other than yourself the right to make decisions on your behalf when you are unable to make them.  It is important it is someone you trust.

There are two types of Enduring Powers of Attorney: -

  1. Property - Covers your money and other assets.

  2. Personal Care & Welfare - Covers your health should you be incapacitated.

  • Trusts

The main purpose of Trusts is to protect and administer your assets and can be used for a number of different situations.  Trusts can continue beyond your lifetime should you so choose.  Trustees are appointed by you to administer the assets.

About Us

Lyn Powell Legal was established in April 2017.  Lyn Powell is the Sole Practitioner of the firm

and has practised since 1973.

​

Lyn attended secondary school at Coromandel District High School and Auckland Grammar, followed by

Auckland University where he completed a Batchelor of Arts Degree.  Lyn also completed a Diploma of Teaching

at Auckland Teachers College and taught English and Social Studies.  Whilst working full time he completed his

Law Degree.

​

In earlier years Lyn appeared in various Courts including the Court of Appeal and what is now the District Court,

High Court and Family Court.

​

Lyn has two sons and five grand children.  Interests, outside of Law,  include a life-long love of cocker spaniels, longstanding membership of the Sarjeant Art Gallery and a membership of the Whanganui Regional Museum.
